CA: Collecting explicit consent to Subscription billing terms
Summary
As of July 1, 2025: California law requires businesses to collect explicit consent to subscription billing terms - meaning that customers must take an action to agree to the terms of the Club (and ongoing automatic charges) prior to signup.
Businesses must also keep verification of the consent for their records for at least three years or one year after the 'contract' (between winery and Club Member) ends.
Steps for Setup
- Setup in Admin
- Go to Setting > Compliance to enable the setting for 'Require Auto Renewal Consent'.
- Update the text Settings > Languages. Both the checkbox and description can be updated.
- Checkbox: Search for 'I acknowledge'
- Description: Search for 'By clicking "Complete Signup"'
- After you've made your changes, click the Save Translation button.
- Go to Setting > Compliance to enable the setting for 'Require Auto Renewal Consent'.
- Where the checkbox appears / where the info is stored
- When signing up for a club online, on the last step, the customer will see a checkbox.
- Customers must check the box, therefore agreeing to terms, before the signup can be completed.
- Once the signup is complete, the date will be stored on the Club Membership beside the Signup Date under 'Auto Renewal Consent Date'. The consent date cannot be edited by an admin.
- When exporting a list of Club Memberships, 'Auto Renewal Consent Date' will be a new column.
FAQ
- Is this feature available for Commerce7 V1?
No. This feature is available for V2 only. - Does this feature appear for Admin or POS signups?
No. It only appears for online signups on your frontend website. - Does this feature appear when customers are signing up for a club using Apple Pay or Google Pay?
No. If the customer is signing up for a club using Apple Pay or Google Pay, the additional consent will not be collected. These payment methods do not currently allow us to add the customization required. - Where can i learn more about this law?
